A seven year battle between residents at the Marquesa at Monarch Beach community nears its end this month as most of the homeowners with trees that exceed the heights of the houses had them chopped down. The Marquesa HoA was ordered by a California judge to enforce its CR&Rs, which include a rules for tree heights that had been ignored by the board for nearly a decade for various reasons, including concern that crowning a palm tree would kill it.
Below are photos of the tree removal from 2 Regina, a property owned by David Christakes, a former HoA boardmember who fought against enforcing the CR&Rs for years before a judge ruled in favor of the plaintiffs.
